Terms of Service

These Terms govern your use of TapJot, a customer-relationship manager (CRM) for independent web designers. By creating an account or using TapJot, you agree to these Terms. If you don't agree, don't use the service. Questions: tjborriello@gmail.com.

1. The service

TapJot helps you track leads, clients, notes, and tasks, draft and send proposals, and bill clients. It includes an AI capture box and payment features powered by third parties (see §8). We may add, change, or remove features over time.

2. Accounts & eligibility

TapJot is currently invite-only. You must be at least 18 and provide accurate information. You're responsible for keeping your password safe and for everything that happens under your account. Tell us promptly at tjborriello@gmail.com if you suspect unauthorized access.

3. Acceptable use

Don't use TapJot to break the law, infringe others' rights, send spam, or upload malicious code. Don't try to disrupt or reverse-engineer the service, scrape it, bypass usage limits (including AI rate limits), or access data that isn't yours. We may suspend or terminate accounts that abuse the service.

4. Your content & data

You own the data you put into TapJot, including the information you record about your own clients and leads. You grant us a limited license to store and process that data solely to operate the service for you. You're responsible for having the right to store and use any personal information about third parties (such as your clients), and for complying with the laws that apply to you. Our handling of data is described in our Privacy Policy.

5. AI features

The AI capture box suggests how to file your notes; it can be wrong, and you review and confirm before anything is saved. AI output is provided as-is and is not professional advice. You're responsible for what you keep and send.

6. Payments

TapJot's billing features let you collect payments from your clients through Stripe. You are the merchant of record for those transactions and are responsible for your own pricing, taxes, refunds, and obligations to your clients, and for complying with Stripe's terms. If TapJot itself charges a subscription or fee for the service, we'll tell you the price before you're charged.

7. Cancellation & termination

You can delete your account and data at any time from your account settings. We may suspend or terminate your access if you violate these Terms or to protect the service. On termination, your right to use TapJot ends; sections that by their nature should survive (e.g. §4 ownership, §9–§10 disclaimers and liability) survive.

8. Third-party services

TapJot relies on Supabase (data & auth), Stripe (payments), Anthropic (AI), and Cloudflare (hosting). Your use of features that depend on them is also subject to their terms, and we're not responsible for their acts or outages.

9. Disclaimers

TapJot is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the service will be uninterrupted, error-free, or that it will meet your requirements. You're responsible for keeping your own records and backups of anything important.

10. Limitation of liability

To the fullest extent permitted by law, TapJot and its operator are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim relating to the service will not exceed the greater of the amounts you paid us for the service in the 12 months before the claim, or US $100.

11. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we'll update the date above and, where appropriate, notify you in the app. Continuing to use TapJot after a change means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the State of New Jersey, USA, without regard to its conflict-of-laws rules. Any disputes will be handled in the state or federal courts located in New Jersey.

Text messaging program

TapJot Client Care Texting, operated by Ello Media LLC (TJ OnCall), delivers service updates and replies about your own website requests. Consent to receive text messages is voluntary and is never a condition of purchasing or receiving any service. You opt in directly with us, either by texting our number first with a request about your website or by asking us in writing to receive text updates. Message frequency varies. Message and data rates may apply.

Reply STOP at any time to opt out. Reply HELP for help, or contact tj@tjoncall.com. Phone numbers and text messaging opt-in data are never shared with third parties or affiliates for marketing or promotional purposes. Full program details: https://tapjot.app/sms/.
